How RosterElf's award and pay templates are intended to be used
1. General information
Please read this disclaimer carefully before using the award templates and pay templates made available in RosterElf ("the Templates"). By accessing, applying or relying on the Templates, you acknowledge and agree to the terms of this disclaimer. This disclaimer supplements, and should be read together with, our terms and conditions.
2. A starting point only
The Templates are provided as samples and a learning aid to help you set up your pay rules more quickly. They are illustrative starting points only — they are not complete, and they are not intended to be used as-is.
You should treat each Template as a foundation to review, adapt and complete for your own business before you rely on it. The Templates do not take account of your specific circumstances, industry, location, or the particular award or agreement that applies to your employees.
3. Accuracy and currency
We do not guarantee that the Templates are complete, current or accurate. Pay rules change regularly — for example, the Fair Work Commission's annual wage review takes effect from 1 July each year, and modern awards and enterprise agreements are varied from time to time.
A Template may not reflect the latest pay rates, penalty rates, overtime, loadings, allowances or employee classifications applicable to your business.
4. Your responsibility to verify
You are solely responsible for reviewing every pay rule and confirming that it is correct and complete for your circumstances before you rely on it. This includes verifying pay rates, penalty rates, overtime, loadings, allowances and employee classifications against the current applicable modern award or enterprise agreement, the Fair Work Act 2009 (Cth) and the National Employment Standards.
The Templates are general in nature and do not constitute legal, payroll or professional advice. You should obtain your own professional advice relevant to your circumstances before acting on, or relying on, a Template.
5. No warranty and limitation of liability
To the maximum extent permitted by law, the Templates are provided on an 'as is' and 'as available' basis and without any warranty, representation or implied term of any kind as to their accuracy, completeness, currency or fitness for a particular purpose.
To the maximum extent permitted by law, we accept no responsibility for any loss, damage, cost or expense — including any underpayment or overpayment of employees, penalties, or non-compliance with workplace laws — howsoever arising from, in relation to, or connected with, your use of, or reliance on, the Templates.
This disclaimer applies in addition to the warranties and limitation of liability provisions in our terms and conditions, which continue to apply. If there is any inconsistency between this disclaimer and the terms and conditions, the terms and conditions prevail.
